Ministry proposes stopping revocation of home ownership certificates

The Ministry of Natural Resources and Environment yesterday sent a document to the Chairman of Hanoi People’s Committee proposing stopping revocation of certificates of home ownership rights from owners of apartments constructed by Muong Thanh Group.
It clearly said in the document that as per the Land Law 2013’s article 106 and the government’s resolution 43/2014 issued on May 15, 2014 and the supplement of the government’s resolution 01/2017 on January 6, 2017, the People’s Committee should stop revocation of certificates of home ownership rights to ensure the interests of apartment owners.
Instead, the Ministry urged to inspect the liability of the investor and relevant agencies to verify responsibilities of each and impose penalties on them.
Through reviewing in a working session with the Hanoi Department of Natural Resources and Environment, the General Department of Land Administration realized the Department had earlier revoked 384 certificates of home ownership rights granted to several owners of apartments in Bemes, Xa La and CT5A, B apartment buildings developed by Muong Thanh Group.
The revoked certificates are of apartments in floors with height exceeding permitted levels and those built in areas that are not allowed.
After the working session with the Hanoi Department of Natural Resources and Environment, the land administration said loose management led to violations in Muong Thanh’s projects triggering difficulties in issuance of certificates of home ownership rights.
The Administration proposed stopping revocation of certificates and issue penalties on project investor and relevant agencies involving in the case and then solve the mater as per the regulation.
