Bus driver indicted for involuntary manslaughter in first-grader death

A school bus driver was yesterday indicted for involuntary manslaughter in the death of first-grader of Gateway International School according to the 128 Article of the Penal Code.

The decision to prosecute accused shuttle driver Doan Quy Phien was approved by the People's Procuracy of Cau Giay District.
Previously, the People's Procuracy of Cau Giay District and police investigators carried out the second time crime scene simulation on August 6 to verify movement of school shuttle from the Press Institute to Gateway School and other details of the incident.
According to preliminary investigation, the driver must be held accountable for the death of the first –grader because he had not checked the vehicle resulting in the child being abandoned in the school shuttle in nine hours.
On the day of the incident, driver Phien and student monitor Quy picked up schoolers including the first-grader. However, they forgot to check whether any students was left in the vehicle before parking it the Press Institute.
Until 3PM, driver Phien drove the school shuttle to pick up students again in the school gate and they discovered the dead student laying down on vehicle floor.
According to the autopsy report, the child died from heat stroke and breathing problem.
Before, student monitor Nguyen Bich Quy was arrested with the charge of unintentional manslaughter on August 27.
Presently, police investigators are considering the responsibility of the school in the death of the child.
