House, land certificate granting shows lot of problems, paradoxes

That was said by National Assembly member Truong Trong Nghia at the working session of HCMC NA Deputies Delegation with the city People’s Committee yesterday.
Reporting to the delegation, Mr. Tran Van Thach, deputy director of the HCMC Department of Natural Resources and Environment, said that by the end of 2013, the city had provided 1,366,776 certificates and basically completed the certificate granting to eligible cases according to Directive 1474 by the Prime Minister.
The Land Law passed by the NA in 2013 taking effect on July 1, 2014 has solved many difficulties for cases unsuitable with plans and granted certificates for an extra of 113,900 long standing cases.
From 2012-2015, the city provided nearly 4,900 certificates over 39,400 hectares for organizations.
The city has required districts to review the number of houses and land plots which have not had certificates this year. Still, so far only 17 out of 24 districts have sent reports with 42,133 cases.
Of these, many have got stuck with plans or broken the Land Law, 21,100 cases have been in dispute, nearly 15,000 properties have been purchased or sold with contracts which are not notarized and nearly 6,100 cases which residents have no need for certification.
Deputy Tran Hoang Ngan said that HCMC is under the large pressure of granting land and house certificates. Besides regulation problems, cadres’ professional ethnics should be improved to speed up the process.
At the meeting, some deputies said that planning failures called hanging plannings have slowed the certificate granting in some districts.
Leaders of the Department of Planning and Architecture said that the agency had been working with relevant agencies and districts to review unfeasible plans to propose the city to remove planning failures, adding it takes time to review 1,000 hectares of urban land.
However congressman Truong Trong Nghia said that projects delayed for over ten years or even 25 years such as Binh Quoi-Thanh Da have largely effected residents’ legitimate rights in land and house. That is the government’s mistake.
In addition, tens of road projects have been approved but relevant agencies have not had specific implementation plans causing thousands of certificate applications not considered, he added.
Saigon Riverbank privatized
Another issue Mr. Nghia mentioned at the meeting is that Saigon riverbank have been privatized with many real estate projects. That is unfair for city residents and will break plans.
So Mr. Nghia proposed the agency to announce planning information along Saigon riverbank for the last past. Where have been delivered to private sector and residents are not permitted to enter.
He also queried about the plan alongside the river’s banks to serve ten million residents and how authorized agencies have handled works illegally encroaching the river.
Stating at the conference, secretary of the HCMC Party Committee Nguyen Thien Nhan, who is head of the HCMC NA Deputies Delegation, recorded the city People’s Committee’s efforts to grant certificates for residents during the last past. However he required the committee to make more efforts as certificate granting operation has yet to meet residents’ demand.
He said that it is time for HCMC to renew the management model of a super city, asked the city People’s Committee to soon send reports to the NA Deputies Delegation, the standing board of the HCMC Party Committee and the People’s Council about the list of projects which have not been implemented for five years or longer along the Saigon river and solutions to tackle the issue.
The committee should report about the land use status quo alongside the Saigon River and how the plans are for 2006, 2010 and 2017 for the city to consider the plans and land use through phases.
