HCMC issues more transparent regulations on land separation

Deputy Chairman of HCMC People’s Committee Tran Vinh Tuyen has signed Decision 60 on land separation with more transparent regulations than previous Decision 33 issued on October 15, 2014.

Under the new decision, taking effect from January 1 next year, minimum area for a housing land separation is 36 square meters and the road in front of the land plot is not less than three meters in width in zone 1 including Districts 1, 3, 4, 5, 6, 8, 10, 11, Go Vap, Binh Thanh, Phu Nhuan, Tan Binh and Tan Phu.
They are 50 square meters and four meters in zone 2 including districts 2, 7, 9, 12, Binh Tan, Thu Duc and towns in rural districts; 80 square meters and five meters in zone 3 covering Binh Chanh, Cu Chi, Hoc Mon, Nha Be and Can Gio districts.
Land separation will base on 1:2000 scale plans approved by authorized agencies. In areas where these plans have not been built, the procedure will follow land use plans.
In addition, Decision 60 permits agricultural land division. Minimum area is 500 square meters for annual planting land and other agricultural land and 1,000 square meters for perennial land, seafood farming and salt making.
If land parcels are unsuitable for farming production and subject to withdrawal, separation will not be permitted. In case they are unsuitable for farming production and not subject to withdrawal, land users can see their rights at Article 49 of the Land Law 2013.
In case land division documents are submitted before the new decision takes effect, district people’s committees will solve as per Decision 33 to grant land use certificates unless land users require to do that according to new regulations.
Inter agencies groups will be established to consider land separation for poor or disadvantageous households with minimum area not smaller than 25 square meters for housing land and 300 meters for agricultural area.
