Bianfishco appeals against previous decision

Lawyer Nguyen Ky Viet, representing the Binh An Seafood Company (Bianfishco), said he has lodged an appeal against a previous decision of the O Mon District People's Court on March 16.

In his appeal, the company lawyer has proposed to the court to review its decision and decide on a lower interest payment of 1.75 per cent a month, for the debt ridden seafood company.

Lawyer Viet also asked for clarification of the court’s decision, if it was based on the current trade law or the civil law.

He also asked the court to take into consideration the fact that farmer Nguyen Van Lien and Pham Thi Mai had already been paid VND1.25 billion and VND1.26 billion respectively, and for the court to also review the legal expenses of the case.

In late February, farmers Nguyen Van Lien and Pham Thi Mai decided to sue the company for non payment of fish for purchases made over a period of time.

Lawyer Nguyen Truong Thanh, representing Nguyen Van Lien and Pham Thi Mai, proposed to the O Mon District People’s Court to force Bianfishco to pay the two farmers about VND15.68 billion (US$758,000) along with VND2 billion as interest.
